Employers urged not to terminate employees on leave

To protect workers’ rights, the Ministry of Administrative Development, Labor and Social Affairs has asked employers not to terminate employees during leave. In two separate posts recently shared on social media platform of the Ministry, the authorities have reminded both employers and employees of two important clauses of Labour Laws dealing with the “Leave”.

One clause binds employers not to terminate employees during their leave while the second clause bars employees from doing any other job for any other employer during the leave.

Article 85 of the Labour Law says: “The employer may not terminate the service contract or notify the worker of the termination thereof during any of his periods of leave provided for in this law. The employer may not notify the worker of the termination of the contract if the notice period expires during any of such periods of leave.”

Article 84 says: “The worker shall not work for another employer during any of his leaves. If it has been proved to the employer that the worker has contravened this provision, the employer may deprive him from his wage for the period of the leave and recover what he has already paid of that wage.”
